Constitution of India - Formation

       The political development of India as an independent and sovereign republic has its immediate historical roots in the period of British rule in India .Economic exploitation by British rule first sowed the seed of nationalistic awakening in Indians. Such awakening slowly organized into a strong for political freedom from alien rule. None of acts made  by the British rulers for the governance of India satisfied the aspirations of Indians. The necessity and eager to frame a constitution 'BY ITS OWN PEOPLEWITHOUT OUTSIDE INTEREFERENCE' was made open by the Indian National Congress in 1935and subsequently during 1938, 1939.

      Constituent Assembly was constituted to frame a Constitution for India. Constituent Assembly elected for undivided for India in December 1946, reassembled on 14th August 1947   as the Sovereign Constituent Assembly for the Dominion of India. According to the recommended scheme by the Cabinet Delegation:

1.  The Provinces elected 292 members while the Indian States were allocated a maximum of 93 seats
2.  The seats in each province were distributed among the three main communities Muslim, Sikhs and General in proportion to the respective populations
3.  Members of each community in the Provincial Legislative Assembly elected their own representatives by the method of proportional representation with single transferable vote
4.  The method of election in the case of representatives of Indian State was to be determined by the Constitution

On 29th August 1947 the Constituent Assembly appointed a Drafting Committee under the Chairmanship of Dr. Ambedkar with the following members:

  • K.M.Munshi
  • Mohammed Sadayuthulla
  • B..L.Mitter ( later replaced by Mr.Madhava Rao)
  • Dr.D.P.Khaitan ( replaced on death,by Sri.T.T.Krishnamachari)

After first and second readings of the clauses the Constitution received the signature of the President of Assembly and was declared as passed in November 1949. The Constitution came into force from 26th January 1950, a day recalling India's declaration of complete independence as its ultimate goal twenty years earlier.

Philosopy of the INDIAN Constitution.

This could be seen that ideal embodied in the objectives resolution is faithfully reflected in the Preamble to the Constitution, which as amended in 1976, summarizes the aims and the objects of the Constitution.

"We the people of India having solemnly resolve to constitute India into a sovereign socialistic secular democratic republic and to secure to all citizens"

  • Justice -Social, Economic, Political
  • Liberty - Liberty of thought, expression, belief, faith & worship
  • Equality- Equality of status and of opportunity and to promote among them all
  • Fraternity- assuring the dignity of the individual and the unity & the integrity of the NATION
